Blake Tishman, P.A. v. Baptist Health South Florida, Inc.
No. 17-62230-CIV, 2019 WL 3890506 (S.D. Fla. Jun. 10, 2019). The Firm represented a hospital system in a lawsuit brought by a chiropractor, who claimed that he had received unsolicited faxes in violation of the Telephone Consumer Protection Act (“TCPA”) The chiropractor sought to establish a class action against the hospital system. Based on the evidence developed by the Firm during discovery and the arguments made by the Firm in opposition to class certification, the Magistrate Judge rejected the chiropractor’s request for class certification in a thorough Report and Recommendation. Shortly thereafter, the lawsuit was dismissed by agreement.
