Fayad v. University of Miami
No. 13-004086-CA (Fla. 11th Cir. Ct. Apr. 26, 2019). The Firm represented a private university hospital in a lawsuit brought by a medical doctor. Following the hospital’s closure of its radiation oncology development and transfer of those services to a separate medical facility, the doctor sued, alleging that, by closing the department, the hospital breached its bylaws and tortiously interfered with his relationships with referral sources and patients. At the inception of the case, the doctor sought an emergency preliminary injunction to prevent the closure. Following an evidentiary hearing, his request was denied. Thereafter, the parties engaged in extensive discovery. At the close of discovery, the Firm moved for summary judgment on all claims, which was granted by the Court.
